These Terms govern your use of the HITUKI Planner iOS application provided by Daisuke Tamura (the “Operator”). By downloading or using HITUKI Planner, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the app.

HITUKI Planner is a device-based planner for plans, records, notes, themes, photos, and reminders. Optional features include weather, speech recognition, AI-assisted text organization, and widgets. HITUKI Planner does not provide medical, legal, financial, or other professional advice. Do not rely on weather, notifications, or AI output as the sole basis for important or safety-related decisions.

Your main content is stored on your device. You are responsible for managing your device, OS and device backup settings, and reviewing your entries.

Data may be lost because of device failure or loss, app deletion, OS issues, or third-party service failures. The Operator uses reasonable safeguards and migrations but does not guarantee that all data can always be preserved or recovered.

Voice input is available only after you accept the in-app disclosure and grant the required OS permissions. Apple speech recognition converts audio to text. HITUKI Planner does not persist the audio file.

The recognized text is sent through HITUKI Planner’s relay service to generative AI on Google Cloud to organize one entry. AI output may be inaccurate, incomplete, or unexpected. Review and edit the output as needed.

Some features are offered through HITUKI Plus. Monthly and annual auto-renewing subscriptions and a one-time purchase may be available. The price, currency, trial, and regional availability shown by the App Store at purchase prevail.

• The annual plan may include a seven-day free trial for customers Apple determines are eligible.
• Subscriptions renew automatically unless canceled before the end of the trial or billing period under App Store rules.
• Payment is charged to your Apple Account. The Operator does not receive your payment-card number.
• Manage or cancel a subscription in iOS Settings or through Apple subscription management.
• Refunds are handled under Apple’s rules and process.
• Use “Restore Purchases” in HITUKI Planner to check an existing entitlement.

When Plus expires, the Operator does not delete your locally stored plans, records, or photos. Plus-only features and content shown in widgets may become unavailable.

• Violating laws, public order, or third-party rights.
• Improperly bypassing, reverse-engineering, or disrupting the app, servers, purchase verification, or usage limits.
• Sending malware, excessive automated requests, or otherwise harming the service.
• Reselling, renting, or offering the app as a commercial service without permission.

Rights in the app, design, text, program, and Operator-provided materials belong to the Operator or their rightful owners. You retain rights in the content and photos you enter into HITUKI Planner.

The Operator may change, suspend, or discontinue the app for improvements, maintenance, security, legal requirements, or changes to third-party services. The Operator will use reasonable efforts to provide advance notice of material effects.

HITUKI Planner is provided “as is.” The Operator does not warrant uninterrupted operation, compatibility with every device, or complete accuracy of AI, weather, or notifications.

Except for willful misconduct or gross negligence, or where applicable law does not permit a limitation, the Operator is not liable for indirect, special, consequential damages, lost profits, or data loss. Nothing in these Terms limits mandatory consumer rights.

The Operator may update these Terms when reasonably necessary. Material changes will be announced on this page or in the app. Continued use after an update constitutes acceptance, except where applicable law requires separate consent.

These Terms are governed by the laws of Japan. Unless mandatory law provides otherwise, the Tokyo District Court has exclusive jurisdiction as the court of first instance for disputes concerning HITUKI Planner or these Terms.
